Just got a call from a friend in SLC that the breaking news is that the jury has already come to a verdict in the Elizabeth Smart case and everyone is currently being gathered to the courtroom, so the verdict can be announced. That was fast. Has anyone out in UT heard when the verdict itself is expected?

Brian was apparently singing Mormon hymns in the courtroom. The reporter thinks he is facing a life sentence for both of these charges, possibly at a mental hospital/prison somewhere.

How many years should he get for singing? Does anyone else find it funny he was singing Mormon hymns?

Too bad that info will go over the heads of most people.

tell me what 'hymns' he was singing. Since Mormon hymns would have significance perhaps lost on TBMs in Utah. I'm guessing that to most TBMS in the morridor a "hymn" is a hymn.

The rest of us want to know if they were Mormon hymns or not.

To spare the victim reliving the gory details?

that got drug up anyway. I think, now that I've watched more of the newsfeed, that it was because no one disputed that charge - the real question was if Mitchell was sane or not.

Kidnapping and transporting across state lines are under federal jurisdiction.

Utah wouldn't file rape charges because they did not deem Mitchell competent to stand trial, and, IMHO, they didn't want a trial because of potential bad PR - same reason Mark Hoffman never went to trial. [Raise your right hand, Mr Hinckley. Do you swear to tell.....]

While I admit to not being burdened with any facts, I agree with the federal determination that he was faking mental illness. Yes, he's a religious nutjob, but you can't swing a dead cat in Utah without hitting one of those. Thinking God talks to you and likes you better than everyone else is pretty much normal in Mormonism.

That's a great observation. I did literally laugh out loud.

Mitchell was incompetent to stand trial.

Or are there none, other than the fact that some otherwise totally bland blonde little Mormon girl went through a horrible ordeal but still adheres to a sick religion that has prepared her to live the mirror image of said ordeal for the rest of her Mormon-God-Ordained pathetic life?

The news HLN- went on about "serene" Ed Smart, her dad and all the work he's done to prevent this horror from happening to others...He's the IDIOT who brought the kidnapper to his house to help with yard work. And Mitchell looked like a psycho case back then! Why not support a shelter instead? Bring home a weirdo so he can ogle your daughters? What impact will BYU's expert saying Mitchell was abiding by old LDS doctrine?

I just rechecked the dockets online. The State of Utah criminal case against Mitchell definitely include aggravated sexual assault. Those charges have never been dropped. The state court specifically denied a motion to dismiss the charges after he was found temporarily incompetent.

The state judge found him incompetent to stand trial at the time, but not that the charges would not be pursued once he becomes competent. The state was the first to charge him with rape. But the federal court stepped in to try him themselves for federal crimes after he convinced the state judge he was incompetent, and the state trial case has remained in limbo pending the outcome in federal court.

Barzee probably won't stand trial until it's convenient for Elizabeth's mission schedule in Paris to be arranged. C'mon, remember your priorities, people!
